Subject
This agreement regulates the rights and obligations of the parties for sales made through the ERCE Photography website in accordance with Law No. 6502 and the Distance Contracts Regulation.
Parties
BUYER: The real or legal person placing the order.
SELLER: ERCE Photography.
By approving the order, the BUYER acknowledges that they will be obliged to pay the product price and any additional charges such as shipping or taxes, and that they have been informed about this.
Definitions
- LAW: Law No. 6502 on Consumer Protection.
- REGULATION: Distance Contracts Regulation.
- SERVICE: Consumer transactions, other than the supply of goods, performed or undertaken in return for a fee or benefit.
- SELLER: The company that offers goods to consumers within the scope of its commercial or professional activity, or acts on behalf of the provider.
- BUYER: The person or entity acquiring, using or benefiting from goods or services for non-commercial, non-professional purposes.
- SITE: The website belonging to the SELLER.
- AGREEMENT: This Distance Sales Agreement.
- GOODS: Movable goods and intangible goods such as software, audio, video and similar digital items used electronically.

Buyer and product information
The recipient, delivery address, phone, email, invoice address, order date, delivery method and product details are determined at the time of transaction together with the order summary.
Basic product features, quantity, unit price, subtotal, shipping amount, total amount and payment plan are shown on the order screen.
Shipping costs, where applicable, are paid by the BUYER.
Security, privacy and personal data
- The privacy rules and related conditions published by the SELLER apply to the protection, confidentiality and processing of information as well as communications on the SITE.
- The SELLER takes the necessary technical precautions within the system infrastructure. However, taking security measures on the BUYER’s own device is the BUYER’s responsibility.
- Data obtained during membership and shopping may be processed in accordance with the law for information, advertising, promotion, sales, marketing and communication purposes.
- The BUYER may contact the SELLER to stop data processing or communications.
- Unless otherwise stated, intellectual and industrial property rights relating to the content and design of the SITE belong to the SELLER.
General provisions
- The BUYER accepts that they have read and confirmed the preliminary information on the main features of the product, the sale price, payment method and delivery.
- The product is delivered within the period stated in the preliminary information and in any event within 30 days.
- The SELLER undertakes to deliver the product complete, free from defects, in accordance with the legislation and together with the necessary documents.
- The SELLER may, with the buyer’s approval, supply a different product of equivalent quality and price.
- If performance becomes impossible, the BUYER is informed within 3 days and the amount is refunded within 14 days.
- If the product price is not paid or is cancelled in bank records, the SELLER’s delivery obligation ends.
- If payment is not received due to unauthorized card use, the BUYER returns the product within 3 days.
- In force majeure cases, the BUYER may request cancellation, replacement or postponement.
- The SELLER may send notifications and communications by letter, email, SMS, telephone and similar means.
- The product must be inspected at delivery; damaged goods must not be accepted; in withdrawal cases the product must not be used and the invoice must be returned.
- If there is a security concern, the SELLER may request verification documents regarding the cardholder.
- The BUYER accepts that membership information is accurate and agrees to compensate any damage arising from incorrect information.
- The BUYER undertakes to comply with the legislation while using the SITE.
Right of withdrawal
In goods sales, the BUYER may withdraw within 14 days from delivery without giving any reason. In service contracts, the period starts on the contract date; the right of withdrawal cannot be used once performance has begun with the consumer’s consent.
To exercise the right of withdrawal, written notice must be provided within 14 days and the product must not have been used. The return process requires the invoice, return form and complete delivery of the product with its box, packaging and accessories.
The requirement to issue a return invoice for corporate invoices remains in force.
Products for which the right of withdrawal cannot be used
The right of withdrawal cannot be used for custom-made products, products unsuitable for return for hygiene reasons, opened books, digital content, software and other products and contracts exempted under the Distance Contracts Regulation.
Default and competent court
If the BUYER defaults in the case of credit card payments, the BUYER accepts that interest may accrue under the agreement with the bank and that the BUYER will be responsible to the bank.
In disputes, complaints and objections shall be made to the consumer arbitration committee or consumer court within the monetary limits set by law.
Entry into force
When the BUYER completes payment for an order placed through the site, the BUYER is deemed to have accepted all terms of this agreement.
